1. INTRODUCTION

    1. “We”, “us”, “our” and “Savic” refer to Savic Motorcycles Pty Ltd ACN 615 314 228 and Related Body Corporates (as this term is defined in the Corporation Act 2001 (Cth)).

    2. Savic is committed to protecting your rights to privacy under the Privacy Act 1988 (Cth) (Act) and we adopt the Act’s requirements which govern the way in which we collect, use and share your information in this privacy policy (Privacy Policy).

    3. Our Privacy Policy explains:

      i. our policies and procedures regarding information we collect from or about our customers and their use of our products and services; and
      ii. how you can contact us if you have any questions or concerns regarding how your information is being collected, used and shared.

    4. By providing information to us or by using our products or services, you agree to the terms and conditions of this Privacy Policy.

2. INFORMATION WE MAY COLLECT

      1. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”.

      2. The Act defines “Personal Information” as meaning information or an opinion about an identified individual, or an individual who is reasonably identifiable:

        i. whether the information or opinion is true or not; and
        ii. whether the information or opinion is recorded in a material form or not. 

      3. We collect two main types of information related to you or your use of our products and services:

        i. information from or about you or your devices; and
        ii. information from or about your Savic motor vehicle.

      4. Depending on the Savic products and services you request, own, or use, not all of these types of information may be collected from you.

      5. The types of Personal Information we may collect about a customer will depend upon the nature of our interaction with the customer.

      6. We may collect the following “Order Information”, “Device Information”, “Vehicle Information” and “Charging Information” from you, but acknowledge some of this information falls within the scope of “Personal Information”:

Order Information

i. your name;
ii. your billing and shipping address,
iii. your payment information (including credit card and bank account details);
iv. your customer registration information;
v. the status of your order;
vi. warranty and other documentation for your Savic Motorcycles products;
vii. your email address and phone number; and
viii. general information about your Savic Motorcycles products (including, for example, vehicle identification number or other product serial number, service plan information, or connectivity package), insurance forms, driver’s licences, financing agreements, and similar information.

Device Information

i. your web browser type and version;
ii. your IP address;
iii. your time zone;
iv. some of the cookies that are installed on your device;
v. media access control address;
vi. computer type (Windows or Macintosh);
vii. screen resolution;
viii. operating system name and version;
ix. device manufacturer and model; and
x. the name and version of the Digital Services (as defined in clause 3.1(a) below), such as the App you are using.

Vehicle Information


i. telematics data regarding the performance, usage, operation, and
ii. condition of your Savic vehicle;
iii. vehicle identification number;
iv. speed information;
v. odometer readings;
vi. battery use management information;
vii. battery charging history;
viii. software version information;
ix. safety-related data and other data to assist in identifying issues and analysing the performance of the vehicle;
x. data about accidents involving your Savic vehicle;
xi. data about remote services (e.g. remote lock/unlock, start/stop charge, and honk-the-horn commands);
xii. a data report to confirm that your vehicle is online together with information about the current software version and certain telematics data;
xiii. vehicle connectivity information including data from your motorcycle such as battery status, motorcycle location, trip history, and user-initiated changes to motorcycle settings (such as adjustments to performance or security features);
xiv. data about any issues that could materially impair operation of your vehicle;
xv. data about any safety-critical issues;
xvi. data about each software and firmware update;
xvii. the customer’s name;
xviii. vehicle identification number;
xix. repair history;
xx. any outstanding recalls
xxi. any outstanding invoices
xxii. any customer complaints; and
xxiii. any other information related to your vehicle’s service history.

Charging Information

i. the charge rate and charging stations used by you (including outlets).

    1. We may also collect the following additional Personal Information from you:

      i. your occupation;
      ii. your gender;
      iii. your location data;
      iv. your traffic data;
      v. your operating system;
      vi. your credit history; and
      vii. any other details you provide to us from time to time.

3. HOW WE COLLECT INFORMATION

1. From your Devices

We may collect information from or about you or your devices in a variety of ways, including:

    1. Digital Services: We may collect information from or about you through our websites, software applications, social media pages, customer support, email messages, our Savic Rider’s App (the App) or other digital services (collectively the Digital Services);

    2. Other sources: We may receive information about you from other sources, such as public databases, joint marketing partners, certified installers, third-party vehicle repair or service centres, and third party social media platforms.

    3. Savic Customer Profile: Customers who purchase a Savic product will have a Savic Customer Profile created based on the details provided in the purchase form. We may collect and process Order Information for your Savic Customer Profile.

      We use the email you provide to bind you to your individual motorcycle. If you sell or transfer your vehicle, you must contact Savic to update the owner’s details to connect the new owner’s profile to the vehicle.

    4. Through your browser or device: Certain Device Information is collected by most browsers or automatically through your device. We use this Device Information to ensure that the Digital Services function properly.

    5. When you visit our website or otherwise use our Digital Services, we may use cookies, pixel tags, analytics tools, and other similar technologies to help provide and improve our Digital Services, and as detailed below:

      i. Cookies: Cookies are small data files stored on your device that help us collect information like browser type, time spent on our Digital Services, pages visited, other web traffic data and language preferences. We and our service providers use this information for security, navigation, personalization, analytics, and to improve your experience. We also gather statistical information about the usage of the Digital Services in order to continually improve their design and functionality, understand how the Digital Services are used, and assist us with resolving questions regarding the Digital Services. Cookies also help us show relevant offers and understand your interactions with our site. You can manage cookie preferences through your browser settings or visit www.allaboutcookies.org. Disabling cookies may affect functionality, such as requiring you to log in more often.

      ii. Pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Digital Services to, among other things, track the actions of users of the Digital Services (including email recipients), measure the success of our marketing campaigns, and compile statistics about usage of the Digital Services and response rates.

      iii. Analytics tools: We use website and application analytics services provided by third parties that use cookies and other similar technologies to collect information about website or application use and to report trends, without identifying individual visitors. The third parties that provide us with these services may also collect information about your use of third-party websites.

      iv. You can learn about Google’s practices in connection with this information collection and how to opt out of it by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptou.


2. From or about your Savic vehicle

    1. General: We may collect and store Vehicle Information and Charging Information from or about your Savic vehicle either in person (such as during a service appointment) or via remote access.

    2. Remote connection: If you are having issues with your vehicle that require a deeper diagnosis, a member of the Savic Software team may request to remotely connect to your vehicle (pending your approval).

    3. Offline: We may collect information from or about you offline, such as when you visit a Savic store or repair facility, attend one of our events, sign up for a test drive, place an order over the phone, or contact our customer service or sales department.

    4. Advanced features: You can opt out of location tracking for your Savic vehicle at any time by using the Savic Rider’s App, navigating to the Privacy settings, and disabling the “Find My Bike Location Tracking” feature. This will stop the collection of your vehicle’s location data but will not affect the collection of other data, such as telematics log data, remote analysis data, or service history, ensuring that non-location-dependent features and services, including remote services (e.g., remote lock/unlock), continue to function normally. Please note that disabling location tracking may affect certain location-dependent functions in the Savic Rider’s App and on your bike, such as real-time navigation and trip history.

4. HOW WE MAY USE INFORMATION WE COLLECT

We may use information we collect to communicate with you, to provide and improve our products and services, and for the purposes listed below.

1. Order Information, Device Information, Vehicle Information & Charging Information

    1. We use the Order Information that we collect generally to fulfil any orders placed through the website (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

      1. communicate with you;
      2. screen our orders for potential risk or fraud; and
      3. when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
        We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimise our website.

    2. We use the Vehicle Information that we collect to:
      1. improve our vehicles, products and services (including the servicing of your vehicle); and
      2. provide remote connection services. The purpose of this is to minimise the hassle of bringing your vehicle into a certified workshop for repairs. This remote connection can be made anywhere if your vehicle has connectivity.

    3. We use the Charging Information that we collect in order to analyse which charging stations are being utilised, how long and efficient battery charges are, and where additional charging stations are needed.

2. To communicate with you

    1. We may use information we collect to communicate with you, including to:

      1. respond to your inquiries and fulfil your requests, such as to send you newsletters or product information, information alerts, information about events, or brochures;
      2. set up, evaluate, and provide feedback regarding your Savic test drive;
      3. advise you of important safety-related information about your vehicle or to notify first responders in the event of an accident involving your vehicle;
      4. send administrative information to you, such as information regarding our products and services, and changes to our terms, conditions, and policies;
      5. present products and offers tailored to you and to enhance our lists with information from other sources;
      6. allow you to participate in contests and similar promotions and to administer these activities; and
      7. facilitate social sharing and communications functionality.

    2. If you no longer want to receive marketing-related emails from us or our Related Body Corporates, you may opt out of receiving them by following the opt-out instructions in any marketing email received from us or by contacting us at the address below. Please note that we may still send you important administrative and safety messages even if you opt out of receiving marketing emails.

    3. If you receive a marketing-related call from us and do not want to receive similar calls in the future, simply ask to be placed on our “do not call” list. Please note that we may still call you regarding administrative, safety, or product service issues even if you opt out of receiving marketing calls.

3. To provide and improve our products and services

We may use information we collect to provide and improve our products and services, including to:

    1. complete and fulfil your purchase, e.g. process your payments, have your order delivered, communicate with you regarding your purchase, and provide you with related customer service;
    2. provide service to your Savic product, such as to contact you with service recommendations and to deliver over-the-air updates to your product;
    3. monitor your Savic product’s performance and provide services related to your product;
    4. develop and promote new products and services, and to improve or modify our existing products and services;
    5. analyse and improve the safety and security of our products and services;
    6. deliver any other services you have requested; and
    7. pre-fill your details in the App.

 

4. Other purposes

 

    1. We also may use information we collect for other purposes, including for our business purposes, such as data analysis, audits, fraud monitoring and prevention, identifying usage trends, determining the effectiveness of our promotional campaigns, and operating and expanding our business activities.
    2. Except as described in this Privacy Policy, Savic may use or share information that is not Personal Information, such as for operational or research purposes, for industry analysis, to improve or modify our products and services, to better tailor our products and services to your needs, and where legally required.

5. WHO WE MAY SHARE INFORMATION WE COLLECT WITH

We may share information we collect with the following parties:

    1. Shopify (the operator of our online store);
    2. Google Analytics;
    3. our service providers and business partners;
    4. our channel partners;
    5. Savic Related Body Corporates;
    6. finance, leasing, registration, title companies, electric utilities, permitting authorities and insurance companies (if their services are requested or required by you);
    7. our employees;
    8. Web hosting providers;
    9. IT systems administrators and electronic network administrators;
    10. mailing houses;
    11. couriers;
    12. data entry service providers;
    13. professional advisors such as accountants, solicitors, business advisors and consultants;
    14. to companies that provide information and infrastructure systems to us;
    15. to investors, agents or advisers, or any entity that has an interest in our business;
    16. any organisation for any authorised purpose with your consent; and
    17. any other parties whom we are permitted to by law.

6. APP PRIVACY

When using the App, we collect limited Vehicle Information to provide key features related to your motorcycle.

    1. Bluetooth Connectivity

      The App requires access to your mobile device’s Bluetooth functionality to pair with your Savic Motorcycles vehicle for proximity-based connectivity and enables secure communication between your mobile device and the motorcycle to support app features.

    2. Motorcycle Data Streaming
    1. The App collects Vehicle Information from your motorcycle.
    2. This data is used solely to provide real-time tracking, display vehicle status, and allow you to control your motorcycle’s features through the App.
    3. The App does not collect or store the GPS location of your mobile device itself, it only collects the motorcycle’s reported location.
    4. You can opt out of location tracking by navigating to the Privacy settings in the App and disabling the “Find My Bike Location Tracking” feature, which will stop the collection of your motorcycle’s location data but will not affect other data collection, such as battery status or bike settings. This may disable certain location-dependent features in the App and on your bike, such as real-time navigation and trip history, but will not affect remote services (e.g., remote lock/unlock).

      We do not use App collected data for advertising, analytics, or any purposes unrelated to providing core App functionality. All data is handled securely and in accordance with this Privacy Policy, and is not shared with third parties.

 

7. CROSS BORDER TRANSFERS

Information from or about you or your use of our products or services may be stored and processed in any country where we have facilities or in which we engage service providers. Those countries may not have the same data protection laws as the country in which you initially provided that information. When we transfer information from or about you or your use of our products or services to other countries, we will protect it as described in this Privacy Policy and take reasonable steps to procure overseas recipients to use personal information only for the purpose provided, to not breach the Act and to implement confidentiality and data protection arrangements. By using our products or services, or otherwise providing information to us, you consent to the transfer of information from or about you or your use of our products or services to countries outside of your country of residence, including the United States.

8. YOUR RIGHTS

    1. Access to Personal Information
      Under the Act, you are permitted to access your Personal Information which we hold. If you would like to obtain such access, please contact us as set out in this Privacy Policy.
      There may be situations where we are not required to provide you with access to your Personal Information, for example, if the information relates to existing or anticipated legal proceedings, if your request is vexatious or if granting access would breach confidentiality or privacy of others.
      A written explanation will be provided to you if we deny you access to the Personal Information we hold about you.
    2. Correction of Personal Information
      It is important to us that the Personal Information we hold about you is accurate and up to date. We may from time to time contact you to confirm if your Personal Information is still current.
      If you wish to make any changes to your Personal Information, you may contact us as set out in clause 13 of this Privacy Policy. We will generally rely on you to ensure the information we hold about you is accurate or complete.
      If we refuse to correct Personal Information, we will provide you with a written explanation and information on how you can request that a statement that you think your information is inaccurate be associated your personal information.
      Please note that we may need to retain certain information for recordkeeping or legal compliance purposes and/or to complete any transactions that you began prior to requesting such change or deletion (e.g. when you make a purchase or enter a promotion, you may not be able to change or delete the information provided until after the completion of such purchase or promotion).

    3. Withdrawal of Consent

      If, at any time, you wish to withdraw your consent to Savic collecting certain information about you, please contact us as set out in clause 13 of this Privacy Policy.
      By withdrawing your consent, you may lose access to certain services or benefits, but we will inform you of this prior to processing your request.

    4. Complaints
      If you have a complaint concerning the manner in which we have dealt with your information, please contact us as set out in clause 13 of this Privacy Policy.
      If we agree your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the complaint.
      If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.

9. SECURITY

    1. Data Protection

      We seek to use reasonable organisational, technical, and administrative measures to protect information within our organisation. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Further, we cannot guarantee the security of information you disclose online - you disclose that information at your own risk. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account with us has been compromised), please immediately notify us of the problem by contacting us following the “How to Contact Us” section below.

    2. Data Breach Notification

      In the event of a data breach that poses serious harm, we will promptly notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches (NDB) scheme.

    3. Retention Period

      We will retain information we collect from or about our customers, our products, and our services for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. When the information is no longer necessary for these purposes, we delete it or keep it in a form that does not identify you. When determining this retention period, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature of our relationship with you, the impact on the services we provide to you if we delete some information from or about you, and retention periods required by law.

10. LINKS

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any site or service to which our Digital Services link. The inclusion of a link on our Digital Services does not imply endorsement of the linked site or service by us or by Related Body Corporates, nor does it imply an affiliation with the third party.

Please note that we are not responsible for the collection, use, or disclosure policies and practices (including the data security practices) of other organisations, such as any other app developer, app provider, social media platform provider, operating system provider, or wireless service provider, including any information you disclose to other organisations through or in connection with our software applications or social media pages.

11. UPDATES TO THIS POLICY

We may change this Privacy Policy from time to time. Please take a look at the “Last Updated” legend at the start of this of this document to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on our Digital Services. If this Privacy Policy changes, we will take reasonable steps to inform you of such changes, either by email to you or as a notification via our Digital Services following the changes.

 

12. CHANGES

We may update this Privacy Policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
